Hey Serus, I too try to avoid agencies. And I thought I knew the couple owning the flat as they visited us for coffee, muffins etc over the course of the tenancy. And then this!

I still believe that landlords who will stab you in the back are the exception, not the rule though. In general, I believe in communication and being proactive. Having an agency in the middle serves a great purpose when one side is not responsive / not accountable. If tenants and landlords are happy with each other then this is a win-win situation.

Hey FF! It’s stressful indeed. I’ve also never had any problems with previous landlords and I’ve moved 5 times so far! I believe some people just want to make a quick buck and they just look cheap in the end.

You see I don’t use agencies on purpose for my rentals. It saves me (and the tenant) a fortune, cuts down on my need for a special estate agent BS filter, and it means the contract is directly between myself and my tenants. If everyone is accountable directly to one another, it just makes sense to me that it will work better. I know these people, and they know me (this all sounds vaguely threatening doesn’t it, its not meant to!).

Fair enough some people have a distance problem with their rental property, and the use of an ARLA approved agent is a necessity, but I am fortunate not to have that problem.

Anyway, I think the DPS arbitration service will provide you with the answers you need on this issue, although fair warning I have heard they have an unfortunately long backlog of cases at the moment.

I’m lucky that I’ve never had any problems with my landlords. Although in some cases I probably haven’t followed the sensible advice in your post (or the advice I’d give myself given that I’m a lawyer). I just happen to have not been screwed over yet. And given I’ll only be renting three more weeks before moving into a flat I’ve bought I’m hoping it doesn’t all end in a massive dose of karma.

As a landlord myself, I find it unbelievable that you are being asked to pay for backdated rent increase.

For your info, I use an ARLA (Association of Residential Letting Agents) registered agency as I want everything to be legal and fair for myself and for my tenants. There is obviously a cost for both but I think it’s the best way.

Good luck with the DPS dispute resolution scheme and hope they find in your favour.
